A man who raped his niece when she was 12 years’ old has been sentenced to 3 years, 3 months and 2 weeks in jail.

Francis Johnson raped his niece when she was living with him and her grandfather at Balon area in Santo.

The Supreme Court heard that he also committed acts of indecency against her on many occasions between July and September 2021.

Mr Johnson admitted his behaviour to the police when questioned. At the time, he was 39 years old, while she was 12.

Judge Maree A MacKenzie of the Supreme Court gave the man a sentence start point of 6 years’ imprisonment, after considering the aggravating factors and previous judgements.

His sentence was reduced by 2 months for his early guilty plea. A further reduction of 7 months was given for his personal factors, such as being remorseful, a first time offender, and cooperative with the police.

Johnson was remanded for 20 days, earning a reduction of 6 weeks from his sentence for this period.

His sentence became effective since October 10, 2024.
