A 23-year-old man was sentenced to almost 5 years’ in jail for having unlawful sexual intercourse with a 13-year-old girl multiple times.

The girl lived with her brother who took care of her. The offender lived with them for a short time and was also regarded as a brother.

In November 2021 when she was away from school having finished her exams, the offender asked her to follow him into a bush not far from their house where he had intercourse with her.

This conduct was repeated several days of the same week. It happened again on Saturday, Sunday and Monday of the following week in the victim’s bedroom, and again in January this year.

The brother of the victim became suspicious and asked her if anything was wrong. She told him the truth. The offender left the following day and did not return.

When arrested and questioned, the offender said he did not know it was wrong to have sex with a 13-year-ld girl because they both had agreed to it, according to the verdict of September 22.

Judge Edwin Peter Goldsbrough stated, “The offender is well-known in his community and is a member of a church and yet he says that he did not know that sex with children under the age of 16, regardless of whether the child agrees or not, is unlawful.

“What is he taught by his chief, and what is he taught by the church?

“It is surprising that it is not within the teaching of either of these authorities that underage sex is not only morally but also legally reprehensible.

“Perhaps a little more public education, especially directed at young men, should be undertaken by both the chiefs and the church.”

The maximum penalty for unlawful sexual intercourse with a girl who is 13 years of age is 15 years’ imprisonment.

The offender was given 7 years as his sentence starting point. He pleaded guilty to his offences and is a first time offender. He was granted a sentence reduction at one-third because of his early guilty plea.

He will serve a sentence of almost 5 years for his crimes, each offence receiving the same penalty and all penalties to be served concurrently.

His sentence started on July 1 when he was arrested. He was given 14 days to appeal the sentence.
