A 17-year-old youth accused of raping a nine-year-old child in North Efate has been denied bail in the Supreme Court.

Judge Oliver Abraham Saksak dismissed the bail application because of the seriousness of the allegations and concerns for the victim’s safety.

The youth has been in custody since February 7, 2026.

He is alleged to have raped the young victim in Paunagisu village, reportedly dragging her into nearby bushes at night.

Judge Saksak ruled that the bail application was premature, noting that the accused had not yet been formally charged and that investigations were still ongoing.

The court stressed the grave nature of the alleged offence, which carries a potential sentence of life imprisonment, and applied established bail principles, including risks of reoffending, interfering with witnesses and failing to appear in court.

Particular weight was given to the vulnerability of the victim.

Justice Saksak emphasised that protecting the child and safeguarding the public must take priority over the accused’s personal liberty at this stage.

The court also found the proposed surety—offered by the youth’s grandmother—to be inadequate, citing a lack of evidence of a strong supervisory relationship.

Additionally, the youth failed to provide sufficient personal details, such as schooling or family responsibilities, to support his release.

Justice Saksak further ruled that there were no adequate assurances that the accused would not interfere with witnesses or commit further offences.
