A 65-year-old chief from Malwa Bay on Malekula has been sentenced to six years and ten months in prison for raping a woman twice during a massage in October 2023.

The Supreme Court heard that the victim regularly received massage from Chief Spenly Salemumu. The first incident occurred at the victim’s home under the guise of providing a massage. The second incident took place at Lakatoro School during a cyclone, shortly after the first rape. The victim and some family members went to the Evacuation Centre at the school to seek shelter when it happened.

After considering the aggravating and mitigating factors, including previous judgements, Judge Maree A. Mackenzie gave the chief a sentence starting point of 8 years imprisonment.

His sentence was reduced by 10 months due to personal factors.

Salemumu is a paramount chief of tribes at Malwa Bay on Malekula. He grew up on Malo Island and is married with twelve children.

Shortly after the two rapes, the chief visited the victim and her husband. He gave the victim and her husband money and apologised. The victim and her husband accepted the apology. They resided on Mr. Salemumu’s land.

“Mr. Salemumu told the presentence report writer that he was remorseful, but it is not clear what he is remorseful for, given his position regarding the offending,” stated the judge.

Salemumu’s sentence was further reduced by 4 months for his time spent in remand. He has been in custody since March 26, 2025 after his bail was revoked.

Judge MacKenzie declined to suspend his sentence.

“Mr. Salemumu is a first offender and as a chief, has an important position in the community. However, this was serious offending, given the aggravating factors detailed above. Mr. Salemumu raped the victim twice. The circumstances, both in relation to the offending and Mr. Salemumu personally, are a long way from being exceptional or extreme so as to warrant suspension of the sentence,” he stated.

The chief was given 14 days to appeal the sentence.
