A man has been sentenced to 4 years and 4 months in jail for raping a child,  which resulted in her pregnancy.

The incident occurred in early 2021 when the defendant was a student at Isangel College on Tanna. At the time he was 21-year-old and the 12-year-old victim was attending Ienaula School.

The Supreme Court heard that the victim went to her sister’s house to sleep, where she met the defendant and others before being left with him to watch movies. Later that night, the defendant forced her into having sex with him and threatened her not to tell anyone.

The offence of unlawful sexual intercourse is a very serious offence, as it carries a maximum penalty of life imprisonment.

Debi Mackenzie pleaded guilty in court.

After considering the aggravating factors, Judge Oliver Abraham Saksak gave him a sentence starting point at 8 years’ imprisonment.

Aggravating factors include the victims young age, the use of force and threats, her vulnerability, risk of disease from unprotected sex, the breach of safety at her sister’s home, the 9-year age gap, and loss of the girl’s dignity as a result.

Judge Saksak reduced the defendant’s sentence by 2 years and 8 months for his early guilty plea, which spared the victim further trauma.

His sentence was further reduced by 1 year due to personal factors such as having no previous conviction, being a good community member and support to his now five-year-old daughter born from the offense.

Mackenzie is willing to participate in a family reconciliation ceremony. He has a wife and a young child. He completed his education at year 13 and involves himself with agriculture and livestock.

His sentence was effected last Friday and backdated to May 28 last year when he was taken into custody.

He is eligible to apply for parole after serving half of his 4 years and 4 months’ sentence.

Mackenzie was given 14 days to appeal the sentence.
