A 48-year-old man found guilty of raping a teenager on Santo in August last year has been sentenced to 4 years and 4 months in jail.

James Melikum was employed as a mechanic at a private garage. He and the victim were residing with the owner of the garage at the time of the offence.

The Supreme Court heard that the 18-year-old victim referred to the defendant as “daddy”. She was sleeping when Mr. Melikum entered the room and inappropriately touched her.

She said “No”, but he continued to touch her and had sexual intercourse with her. This happened when others had gone out.

The court heard that the victim tried to break free but she was weak, as she was recovering from her illness and operation.

Mr. Melikum placed a thick blanket over her face and restrained her from calling out during the offence.

He left the room when he heard his employer’s truck arrive.

Judge Viran Molisa Trief assessed the aggravating factors before adopting a sentence start point of 6 years imprisonment. She reduced the sentence by 7 months for Melikum’s personal factors.

The accused has three children and is separated from his wife who is away on seasonal work. He has no prior convictions, and is willing to pay custom compensation to the victim after the case has finished.

Melikum was given a further 13 months reduction for time spent in custody, from September 3 last year to February 26 this year.

His final sentence is 4 years and 4 months.

Judge Trief stated in the verdict dated May 25th 2026 that it is not possible to suspend all or part of the sentence due to the seriousness of the offending, as there are no exceptional circumstances warranting suspension.

The accused was expected to present himself to the Correctional Centre in Luganville on Monday last week to begin serving his sentence. The Manager of the Correctional Centre should inform the court if he fails to comply.

Mr. Melikum was given 14 days to appeal the sentence.
