A man who raped his 12-year-old niece and threatened to beat her if she reported it to anyone, has recently been sentenced to 6 years in jail.
The unlawful sexual intercourse had taken place during a feast at night on 27 October 2022 when the drunk 41-year-old defendant, Sammy Ishmael, had sent his niece to the store to buy some tinned fish and later followed her without her knowing.
He pulled her into a coconut plantation where he removed both of their clothes, and raped her. On their way back to the feast, he took her to a banana patch and made her perform oral sex on him.
According to the verdict, these unlawful acts caused the girl to become unconscious, she fainted, and when she regained some strength, and walked home, she was continuously bleeding resulting in her changing her clothes five times that night. The bleeding continued and she told her mother, thus the matter was reported to the police.
The victim was immediately transferred to Vila Central Hospital (VCH) where the doctor’s medical examination recorded that the penetrations caused multiple intimate internal injuries.
The Defendant admitted his offending to the police and was charged with unlawful sexual intercourse with a child under 13 years old, which are charges, 1 and 2, and an act of indecency with a young person (under 15 years old), which is the third charge.
He was sentenced to 4 years’ imprisonment for charges 1 and 2, and 2 years’ imprisonment for charge 3, totalling up to 6 years’ imprisonment altogether. The sentence was effective since 18 October 2023, when Ishmael was taken into custody.
