Young man jailed for raping 8-year-old child

A 22-year-old from Epi was sentenced to serve 2 years and 6 months for raping an 8-year-old child in April 2023.

The Supreme Court heard that the incident happened in the victim’s bush kitchen by force. The victim was playing with friends when he called her to watch a movie and instructed the others not to follow.

Willie Sam pleaded guilty to a charge of unlawful sexual intercourse contrary to section 97 of the Penal Code (CAP 135). The maximum penalty for this offence is life imprisonment.

Judge Maree MacKenzie gave him a sentence start point of 5 years’ imprisonment after considering past judgements and aggravating factors.

His sentence was reduced by 20 months due to his early guilty plea.

He is a first-time offender with good family and community support. He is in a relationship and expressed remorse for his action. Due to these factors, his sentence was reduced by 6 months.

A custom payment was made after a ceremony and accepted by the victim’s family. The payment included a pig, kava, bananas, mats, water taro, calico, and VT3,500 in cash. His sentence was further reduced by 4 months because of this.

The judge stated that there was nothing exceptional about the circumstances or his character to justify suspending his sentence despite his youth.

“You (Sam) took advantage sexually of a vulnerable young female. This must be strongly condemned,” the judge stated.

Sam’s sentence is effective from October 7.

He was given 14 days to appeal the sentence.

65-year-old woman gets suspended sentence for possessing cannabis

A 65-year-old woman was sentenced to six months in prison for cannabis possession, with the sentence suspended for 12 months.

Marie Galinie pleaded guilty to possessing 46.2 grams of the drug.

She was caught shaping the cannabis into balls, wrapping them in foil, and placing them inside a container in September last year. When questioned by the police, she admitted it was for her personal use.

Galinie was given a 12 months’ sentence start point, which was reduced by 3 months due to his early guilty plea. She received a further 2 months’ reduction due to personal factors, such as being a first time offender, his age and cooperation with the police.

Galinie was held in custody for 16 days. She received a one-month reduction in her sentence for this.

Judge Maree MacKenzie of the Supreme Court decided to suspend her sentence after considering the circumstances and nature of the offending.

Galinie was warned that she will serve her sentence if is she reoffends within the next 12 months, including any penalties for additional offenses.

The judge ordered for the cannabis material to be destroyed.
