A 35-year-old man who admitted to sexually violating his 7-year-old niece on Santo last year has been jailed for six years.
The married man pleaded guilty to committing an act of indecency with a young person and unlawful sexual intercourse with a child under 13 years of age.
The man is married to the victim’s elder sister. He escorted the minor to the shops one evening and on their way home, he took her on a dark road and touched her inappropriately.
He then had sexual intercourse with the child. The minor was crying, but was unable to stop him.
The offending came to light in January this year when the victim’s sister noticed her trying to hide from her husband. The man admitted his wrong when questioned by the police.
The maximum sentence for an act of indecency with a young person is 10 years’ imprisonment, and for unlawful sexual intercourse with a child under 13 years, life imprisonment.
The man was given a sentence starting point of 8 years and 6 months’ imprisonment.
His sentence was reduced by 25% due to his early guilty pleas, and a further 4 months reduction due to his personal factors.
He is married with three children and has no previous conviction.
His end sentence for unlawful sexual intercourse with a child under the age of 13 was 6 years’ imprisonment. For the charge of act of indecency, his end sentence was 1 year and 6 months. The sentences are to be served concurrently.
The man has already spent time in custody therefore his sentence will commence on February 18, 2022.
His offending was too serious to consider a suspension.
He was given 14 days to appeal his sentence.
