A 25-year-old man from Nguna, Russel Tatangis, has been sentenced to 4 years imprisonment for unlawful sexual intercourse several times with a younger person.

Tatangis committed these offences with the young person who came to live with them as her school guardians. The penalty for unlawful sexual intercourse with a child between 13 and 15years is 15 years imprisonment.

There were no mitigating aspects to this offending. Having considered the aggravating factors, Judge G. A Andree Wiltens gave Tatangis a sentence start point of 6 years 6 months imprisonment.

The sentence was later reduced due his early guilty plea and personal factors.

Tatangis is in a de factor relationship with a one-year child to support. He earns his income in construction and has previously been a seasonal worker. He has no previous convictions and was remorseful for his actions. He also has apologized to his family, his church and the wider community.

He has already spent some time in custody. His sentence is effective from November 19, 2021.

He was given 14-days to appeal the sentence.
