A man from Emua village in North Efate has been sentenced to 2 years and 8 months’ imprisonment for unlawfully entering a dwelling and committing an act of indecency with a child under the age of three.

The offence took place in 2016, and the sentence was handed down by the Supreme Court on 2 July 2025.

The court heard that Richard Frank unlawfully entered a home while a toddler was asleep. The child’s father found Frank with his trousers down, lying behind and in close physical contact with the victim.

Frank pleaded guilty to the charges, which were laid four years after the incident.

The maximum penalty for unlawful entry into a dwelling is 20 years’ imprisonment, and 10 years for an act of indecency with a young person.

Justice Josaia Naigulevu adopted a starting point of 4 years and 8 months after weighing the aggravating and mitigating factors.

The sentence was reduced by 25% for the early guilty plea, and a further 12 months were deducted for personal factors including lack of prior convictions and participation in a custom reconciliation ceremony.

Frank, now 28 years old, is a labourer, mainly working in road construction. He is single and lives with his parents.

Justice Naigulevu declined a request to suspend the sentence. “Your counsel has urged this court to suspend your sentence. Suspending your sentence cannot possibly be countenanced,” the judge said.

“There are two reasons for this. The first is that the offending was too serious. Due to the nature of the offending, suspending all or part of the sentence is inappropriate.

“The second reason is that you deliberately evaded police and the law for a prolonged period of four years and two months. You constantly moved to and from Efate Island to avoid arrest.”

Frank was on bail and required to appear for sentencing on 29 March 2021, but failed to attend.

He has been given 14 days to appeal the sentence.
