Father jailed for incest, indecency

A 36-year-old father has been sentenced to six years and seven and a half months in prison for incest and indecency against his biological daughter when she was under 16.

David Johnson pleaded guilty to the offences.

The Supreme Court heard that he and the victim’s mother had separated. The victim lives with her maternal grandparents at Nambatri in Port Vila, while Johnson rents a house next door in the same yard.

The abuse began in 2022 when the victim was in Year 8 and continued into 2023. Refusing to stay silent, she confided in a family member, leading to Johnson’s arrest.

Judge Viran Molisa Trief set a sentence starting point of eight years after considering aggravating factors.

Johnson originally pleaded not guilty to all five charges. The trial was scheduled twice. After 13 months, he changed his plea, admitting to three charges while denying two. The two charges were dropped, and he was sentenced based on the three he admitted.

His sentence was reduced by ten and a half months for his guilty pleas and a further two and a half months for personal circumstances.

Johnson has no previous convictions. He previously worked for the Port Vila Municipal Council and participated in the seasonal employment scheme but has not returned since the offences.

He had already served three and a half months in custody, which was deducted from his sentence.

Johnson was ordered to begin serving his sentence immediately.

He has 14 days to appeal.

43-year-old given suspended sentence for indecency

A 43-year-old man from Port Olry, Jean Leon Frank, has received a suspended sentence after pleading guilty to indecency.

Frank inappropriately touched the victim while drunk during the opening of the National Bank of Vanuatu branch on East Santo in September 2020.

Under the Penal Code [CAP. 135], the maximum penalty for indecency without consent is seven years’ imprisonment.

Judge Viran Molisa Trief of the Supreme Court gave him a sentence start point of 12 months’ imprisonment after considering the aggravating factors.

His sentence was reduced by two months for his early plea and another two months for personal reasons.

Frank was warned that he will be taken into custody to serve his full sentence if he is convicted of any offence during the 12-month suspension period.

He was ordered to complete 100 hours of community service within 12 months.

He was also given 14 days to appeal the sentence.
