The Minister of Justice, Job Andy, has formally instructed President Nikenike Vurobaravu to revoke Order No. 88, which commuted the sentences of mass detainees.

While acknowledging the President’s powers as stipulated under Article 38 of the Constitution of the Republic of Vanuatu, the minister reiterated that in his instruction on May 13, 2025, he had raised how serious some crimes were and why the punishments were harsh.

In his letter dated May 14, he stressed the need to redress this matter accordingly.

He repeated that some of the prisoners had just been sentenced for very serious crimes and were still considered dangerous. Because of this, they should stay in prison longer and complete required programmes to help them change.

Minister Andy maintained that early release of these individuals could compromise public safety and undermine the principles of justice. He further stressed the necessity of ensuring victims’ rights, saying that many victims reside within the community and require assurances of security.

“Our integrity in the administration of justice is paramount,” Minister Andy stated. He pointed out the need for the justice system to remain fair and responsible. He also recognised the growing public outcry and criticism over the commutation decision.

In the interest of due process, Minister Andy formally directed the Office of the State to initiate revocation proceedings for Commutation Order No. 88 of 2025.

“We seek your due diligence to redress this matter to pave the way for peace and harmony in our nation,” he conveyed to the President.

“As Minister responsible, I write to instruct your high office to revoke the Commutation of Sentence Order No. 88 of 2025.

“Thank you for considering my request in this matter and we hope to get a favourable response at your earliest convenience.”
